The Gardyn Referral Program (“The Program”) allows owners of Gardyns (“Gardyners”) to earn free month(s) of membership by referring friends to buy a Gardyn.

To participate, Gardyners must agree to these terms, which become part of the Gardyn Terms of Service. Capitalized terms that are not defined here will have the same meaning given to them in the Gardyn Terms of Service.

How to Earn free months of membership through referral

Gardyners can earn free month(s) of membership if: (i) a referred friend purchases a Gardyn by clicking on the referral link or adding the referral code to complete the purchase on Gardyn’s website; and (ii) the referred friend does not return their Gardyn Home device within the return period defined in Gardyn’s return policy. This case is referred to as a successful referral.

For every successful referral, the referring Member will be credited with free month(s) of membership as indicated on the promotion. This will appear in the Gardyn Mobile Application within 24 hours following a successful referral but its validity is subject to the related Gardyn not to be returned within the return period. In case the referred friend returns their Gardyn, the related credit will be voided.

12 free months of membership is the maximum that can be earned per Gardyner when the referral discount is valued at $125. If the referral discount is increased for promotional purposes, the maximum free months of membership that can be earned will be 6 per Gardyner.

In order to redeem the free months of membership, you must have a valid credit card on file with your Gardyn account. Adding a credit card to your account enables auto-renewal of your membership, which you may cancel at any time.

If for any reason you believe that there is a discrepancy regarding your balance of free month(s) of membership, please contact us. Gardyn may require you to submit additional information in order to make a determination regarding your balance. All decisions regarding your balance will be final and at Gardyn’s sole discretion.

You are responsible for any Tax consequences, if any, that may result from your redemption or use of free month(s) of membership. Where applicable, Gardyn may be required to account for VAT on any services for which the free month(s) of membership are redeemed.

Sharing Referral Links and coupons

Referrals should only be used for personal and non-commercial purposes. Referral links should not be published or distributed on commercial websites (such as coupon websites). Gardyners are prohibited from “spamming” anyone with referral invitations. This includes mass emailing, texting or messaging people you do not know or using automated systems or bots through any channel to distribute your referral link. Gardyners are prohibited from paying to advertise their referral links.

Referred Friends

Referred friends who are using a valid referral link will receive a credit in the form of a coupon or coupons in the amount(s) indicated in the referral invitation or accompanying promotional materials. Coupon codes that are not automatically applied must be entered during checkout. Coupon codes may not be transferred to another person, exchanged for cash, or combined with other Gardyn referral programs or incentives. Each coupon code may only be used on www.mygardyn.com in conjunction with the booking of a single eligible Gardyn Home device that meets the minimum total value (excluding taxes) indicated in the referral invitation, accompanying promotional materials, Gardyn website, or Gardyn mobile application.

Coupon codes expire at the latest one year after they have been issued. Offer available while seats last. Gardyn reserves the right at its sole discretion and without prior notice to change the credits attached to coupons or cancel coupons altogether. No damage or reimbursement or exchange or compensation can be claimed by the referring Gardyners or referred friends.

Gardyn reserves the right to any remedy, including cancellation of your coupons and related credits, if fraud, tampering, violations of these terms or Gardyn’s Terms of Service or Payments Terms of Service, or technical errors are suspected. Void where prohibited. If your purchase later qualifies for a refund, the maximum refund you may receive is the amount you actually paid.

Multiple Referrals

A referred friend may only use one referral link. If a referred friend receives referral links from multiple Gardyners, only the Gardyner associated with the referral link actually used by the referred friend will receive the credit.

The Program may not be combined with other Gardyn referral programs, incentives, or promotions. If a referred friend receives referral links from multiple Gardyn referral programs, only one referral can be applied for a given purchase, voiding all the other referrals.

Severability

If any provision in these terms are held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions.

Termination and Changes

Gardyn may suspend or terminate the Referral Program or a user’s ability to participate in it at any time for any reason.

We reserve the right to suspend accounts or remove free month(s) of membership if we notice any activity that we believe is abusive, fraudulent, or in violation of the Gardyn Terms of Service. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals in our sole discretion as deemed fair and appropriate.

The scope, variety, and type of services and products that you may obtain by redeeming free month(s) of membership can change at any time.

Updates to the Terms

We can update these terms at any time without prior notice. If we modify these terms, we will post the modification on the www.mygardyn.com website, applications, or services, which are effective upon posting. Continued participation in the Program after any modification shall constitute consent to such modification.
